GENERAL conditions OF SALE.

PARK’N’WASH SAGL invites you to get to know actual general conditions of sale before making the purchase of the services offered at www.parknwash.ch.

Present general conditions of sale must be accepted at the moment of placing the order, together with “Privacy information" of PARK'N'WASH SAGL available separately at the same website.

1. SUBJECT

Present terms and conditions govern the contract between PARK'N'WASH SAGL with registered office in Lugano, Via S. Balestra, 18, registered in the Commercial Register of the Canton of Ticino with the no. CHE.260.688.234, and the Customer (hereinafter referred to as the "Contract").

The Contract relates to the supply of specialized internal and external car cleaning services with the use of ecological and innovative methods.

The service is provided at the customer's home or in a private place as indicated.

The provision of the service implies full acceptance, without reservations, of these general conditions of sale (hereinafter referred to as "GCS").

The present CVG will remain valid and effective until they are modified and/or supplemented by PARK'N'WASH SAGL.

2. CLIENT SERVICES

For any technical and/or administrative issues or further information regarding the methods of execution of the services offered by PARK'N'WASH SAGL send an email to info@parknwash.ch.

3. PAYMENT METHOD

Payment for the requested service can be made by credit card. This can be done by entering the credit card details as indicated on the site and carrying out payment before the service or paying physically after the service directly to the staff who performed the service.

It is also possible to pay in cash after the service directly to the personnel who carried out the service.

PARK'N'WASH SAGL will maintain the security of the information concerning the personal data.

4. FEES

The published fees for the provision of the service are expressed in Swiss Francs, VAT included and are those available at the moment of sending the purchase order.

In the event of PARK'N'WASH SAGL making a change in the fee after the order, whether it is decreasing or increasing, the customer will not recognize any difference and no integration will be applied.

5. ACCEPTANCE OF GENERAL CONDITIONS OF SALE

The validity and effectiveness of the Contract imply acceptance of every condition up until here, not acceptance of the GCS without any reservation on the part of the Customer in addition to the payment.

6. PURCHASE PROCEDURE

The client is able to purchase the services presented at the website www.parknwash.ch and thoroughly illustrated there.

The publish of the offered services at the website constitutes the invite to the Client to formulate a contractual purchase proposition. The order sent by the Client has a value of a contractual proposition and possesses the full and integral acceptance of thee current CGV.

Acceptance of the contractual proposition takes place upon sending of the order confirmation e-mail by PARK'N'WASH SAGL to the electronic address of the Client who placed an order.

7. SERVICE PERFORMANCE AREA

The services provided by PARK’N'WASH SAGL are offered solely in the city of Lugano and at the radius of 10 (ten) kilometers calculating from Lugano.

8. SERVICE CHOICE

The Client, while placing an order have to choose the service indicated expressively:

• Type of the vehicle (small/city car, medium/ sedan and large/SUV/Off-Roader and luxury vehicle);

• Only external and internal cleaning or additional service such as:

- Cleaning of windows inside;

- Elimination of odours inside;

- Tyre black polish;

• Reservation of the date and time;

9. DURATION OF THE SERVICE AND PUNCTUALITY

The services offered have duration from 55 until 90 minutes and this indicated for every service.

The service of PARK’N’WASH SAGL will be executed at the time of the reservation with a maximal late-tolerance of 15 minutes.

If the responsible person from PARK’N’ WASH SAGL arrives on time at the place indicated by the Client and in the next 15 minutes the Client or the car object to service is not present, PARK'N'WASH SAGL reserves the right to withhold 50% of the already executed payment of the Client.

10. RIGHT OF CANCELLATION

PARK’N’WASH SAGL guarantees the right of cancellation to the Client up until 3 hours before the requested service time.

The cancellation must be effectuated via the link provided in the confirmation e-mail from PARK’N’WASH SAGL.

PARK'N'WASH SAGL has the right to withdraw from the Contract due to accident and/or a greater force at any time before the requested service time without payment of any penalty.

11. RESPONSIBILITIES OF PARK'N'WASH SAGL

PARK’N’WASH SAGL is responsible to maintain efficiency of the offered service.

Should it be forced to interrupt the service due to exceptional events, it will try to contain the interruption time as quickly as possible.

PARK’N’WASH SAGL declares to be insured and liable for any damage that may be caused to the car as a direct consequence of the service offered by the it.

PARK'N 'WASH SAGL will not be held responsible for any damage caused by defects present in the car prior to the intervention of PARK'N 'WASH SAGL.

12. MISCELLANEOIS

PARK'N'WASH SAGL has the right to modify these general conditions of sale at any time.

The changes made to the GCS do not apply to orders already confirmed by PARK'N'WASH SAGL.

The contractual relationship is governed by Swiss law and in the event of disputes arising from the execution and / or interpretation of the same, the competent court is Lugano.

INFORMATION ON PRIVACY

The processing of your personal data will take place in particular for the purpose of carrying out everything necessary for the provision of the requested Services.

Your personal data provided through this website will be acquired and processed in paper form and/or  in magnetic, electronic or telematic support in full compliance with the provisions of the Federal Law on data protection (LDP). The processing of such data may take place for statistical and/or information purposes. The provision of the data is therefore optional and your refusal to provide them and/or to the subsequent processing will make it impossible for the the company to enter the data in its archive and consequently establish any relationships with you.

With regard to the data itself, you can exercise the following rights:

1.The interested party can ask the holder for the data collection if data concerning the interested party is processed.

2. The interested party has the right to obtain the indication:

a) all data concerning him contained in the collection, including available information on the origin of the data;

b) the purpose and, if applicable, the legal bases of the processing, the categories of data processed, as well as the participants in the collection and the recipients of the data;

c) the subjects or categories of subjects to whom the personal data may be communicated;

d) the identity of the holder of the data collection and the purposes of the data processing.

3. The interested party has the right to obtain:

a) updates, rectification of inaccurate personal data or, when interested, integration of data;

b) the cancellation, transformation into anonymous form or blocking of data processed in case of  violation of the law.

4. The interested party has the right to object, in whole or in part:

a) for legitimate reasons, to the processing of personal data concerning him, even if pertinent to the purpose of the collection;

b) to the processing of personal data concerning him for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.

The data controller is the company Park'N 'Wash Sagl with registered office in Via S. Balestra, 18 - 6900 Lugano - Switzerland.

Having said that, in the absence of written communications to the contrary from you, we consider that Park'N 'Wash Sagl has given consent to the use of your data for the purposes indicated above.
